Con questo titolo avevo aperto un thread sul primitivo "AreaForum".
Il thread è ancora leggibile sul nuovo AreaForum3 che ha riattivato tutto il precedente contenuto.
Peccato che anche qui non ci siano gli interventi di allora (per esempio di Adam che si diceva d'accordo con questo tipo di spionaggio accettando la versione degli stessi "spioni" che, ammettendo di aver spiato, dichiarano che la cosa è in regola con le leggi americane e sostengono che è nel solo interesse degli stessi americani essendo qualcosa di opportuno per prevenire atti di terrorismo; e di ART che considerava il tutto perfettamente normale in quanto abituale, e diceva che anche l'Italia fa da sempre uno spionaggio con tecnologie sofisticate e di qualità).
Diverso il mio parere [allora condiviso da Guya] che ravvede in ciò ancora una volta la protervia della pptenza egemone e denuncia l'asimmetria tra USA ed UE nel trattamento dei dati dei cittadini sottolineando che ancora una volta siamo sì tutti uguali ma c'è chi è più uguale degli altri.
Successivamente, per sottolineare l'importanza delle rivelazioni su questo spionaggio "yankee", avevo citato un buon numero di articoli di EUobserver.com relativi all'argomento (e in particolare all'accanimento con cui la CIA persegue Snowden, costretto a chiedere asilo politico – negatogli dai governi degli stati dell'UE e concessogli invece dalla Russia di Putin).
Infine avevo riportato (sempre da EUobserver.com) notizie sul temporaneo "sequestro" – in pratica, benché formalmente sia stato dato come conseguenza di tutt'altro – dell'aereo di Morales (costretto ad atterrare a Vienna) in quanto sospettato di ospitare Snowden per portarlo in salvo in Bolivia.
Ieri ho ricevuto (via e.mail) il "Commentary No 359, Aug. 15, 2013", il consueto "Commento" di politica fatto da Immanuel Wallerstein, che esce due volte al mese.
Il titolo è «U.S. Government espionage».
Merita senz'altro una lettura.
Perciò lo trascrivo integralmente.
Vediamo se Adam torna a dire la sua.
E speriamo che finalmente qualcuno si decida pure a non lasciare che questa sezione resti un monologo del solo Erasmus ...

Commentary No. 359, Aug. 15, 2013
"U.S. Government Espionage"
Espionage is an eternal activity of governments. Once upon a time, governments spied primarily on other governments. Today, they spy on everybody, and I do mean everybody. We all have learned recently, thanks to whistle-blowers, Wikileaks, and the British newspaper, The Guardian, just how extensive has become the reach of the United States, which apparently has the most extensive espionage system of any government in the world, in particular, that of the National Security Agency (NSA).
Strange as it may seem to the spyers, many ordinary people who are not themselves spies or engaged in nefarious activity are both surprised to learn that their privacy has been massively invaded and do not appreciate the experience.
What the NSA has been doing is what is called mining metadata. That is, they arrange that the services that transmit emails and telephone calls turn over to the NSA whatever records they have for analysis by the NSA of "patterns" that are presumed to reveal actual or potential "terrorist" activity.
Presumably, the initial element to evoke suspicion is some communication between someone outside the United States and someone inside the United States. However, this then is expanded to include all communications between the person inside the United States and all others. And then, it includes all communications between these "others" and the others to whom they communicate. At this point we are talking of a network that includes virtually the entire population of the United States.
The legal justification for this activity is Section 215 of the Patriot Act, which allows the FBI to apply for an order to produce "tangible things" in order to protect against "international terrorism." The order is adjudicated (virtually always successfully) by the Foreign Intelligence Surveillance (or FISA) Court. The criteria of judgment and the government's arguments to the court are secret. This now very extensive activity is what was revealed by Edward Snowden, and what has caused an uproar. For some people, the revelations were a complete surprise. For others, they merely confirmed what they long suspected. For the government, they were a major embarrassment.
There were three major reactions to the revelations. The first was that of the U.S. government. While President Obama asserted that debate on these issues was desirable and promised some increased "transparency" of the decision-making process, he also has pursued Snowden in the fiercest possible way, seeking to bring him to a U.S. court for trial and severe punishment.
The second major reaction was that of other governments throughout the world, who discovered they were the active object of U.S. espionage (something they of course already knew). At the same time, the revelations of Bradley Manning and Edward Snowden together also revealed the degree of co-operation between western European governments and Japan with the NSA operations.
But the most interesting reaction occurred in the U.S. Congress. Hitherto, opposition to such activities by members of the U.S. Congress had been quite marginal. Suddenly, it became large-scale. Two members of the House of Representatives, Justin Amash and John Conyers, joined forces to propose a measure that would have curtailed the “indiscriminate collection" of such records.
There are two things to note about the Amash-Conyers amendment. Justin Amash is a far-right Republican, a so-called libertarian Republican. John Conyers is a prominent senior member of the "progressive" (or "left") wing of the Democratic Party. The second thing to note is that they were combated by another unusual pair - President Obama and Speaker of the House John Boehner. It was the "establishment" against the "extremes." The vote was 205 for (94 Republicans and 111 Democrats) to 217 against (134 Republicans and 83 Democrats) with 12 abstentions.
The defeat of the amendment was secured only by the most intensive lobbying by Obama and Boehner. Furthermore, most remarkably, the very author of Section 215, Rep. James Sensenbrenner (Republican of Wisconsin), angrily denounced the government for not carrying out the intent of what he wrote. He said the word about "relevant" records was meant to limit the government's authority, not extend it. He also reminded the "establishment" that the clause expires in 2015 and said: "Unless you realize you've got a problem, this is not going to get renewed."
So where are we? The government (whether Democrat or Republican) will attempt to mollify verbally the protestors while nonetheless continuing to invade everyone's privacy. They will use (or manufacture) terrorist plots to justify this. But the whistle-blowers have undermined their legitimacy and this is what hurts, and why the government is being so vindictive with them.
Will something like the Amash-Conyers amendment pass next time? It is hard to say, but quite possibly. And if it does, what then? Well, it depends a bit on who is in power. Would Amash be as hard on a putative President Rand Paul? Possibly not. What we can say nonetheless is that the legitimacy and authority of the U.S. government, internally, has eroded severely. When you add this to the serious and continuing decline in geopolitical legitimacy and authority, the United States is beginning to look like one of the less stable countries in the world-system, not one of the bedrocks.

Caro Erasmus, convengo in toto con le tue considerazioni sulle quali, peraltro, non mi sembra ci sia molto da aggiungere. Che gli USA siano i "padroni" non dichiarati del mondo occidentale è cognizione comune, basti per questo leggere qualche statistica sulle basi militari e sugli impianti di telecomunicazione attivati in tutto il mondo e, in particolare, in Italia.
Lo spionaggio come prevenzione di possibili atti di terrorismo può avere di certo una giustificazione, visto quanto abbattutosi sugli USA l'11 settembre di molti anni fa, ma non dimentichiamo come dietro questa spiegazione si nascondano spesso obiettivi di ben altra natura. Lo testimonia clamorosamente l'entrata in guerra contro l'Irak, sulla base di presupposti costruiti ad arte, vale a dire la presenza di ordigni nucleari e di altre armi di sterminio di massa, oltre ai presunti legami con Al Qaeda. Volgari panzane di appoggio ad una invasione finalizzata tanto al controllo dell'attività di estrazione petrolifera che al consumo di ordigni bellici, la cui omonima industria rappresenta la prima per importanza per l'economia di quel Paese.
Sempre in tema di sequestri, non dimentichiamo anche quello di Abu Omar, eseguito dalla CIA sul nostro territorio in assoluto dispregio della nostra sovranità e del diritto internazionale. Situazione che si è conclusa con la farsesca concessione della grazia a Joseph Romano, condannato in appello dal Tribunale di Milano per la citata vicenda. Altrettanto farsesca è apparsa la cattura di un altro agente Cia (ora ex-) in territorio panamense conclusosi con il suo rilascio proprio per evitare l'arresto e l'estradizione in Italia.
Una bella democrazia davvero....

Non si fermano gli "X – files" concernenti lo spionaggio americano sulla privacy degli europei.
Dopo le clamorose dimissioni del governo lussemburghese in luglio per il sospetto che qualche ministro fosse sui "libri-paga" della NSA, ecco esplodere analogo e ben più fondato "affare" in Francia. In un solo mese oltre 70 milioni di registrazioni telefoniche abusive. Questa volta lo scopo sarebbe stato "pescare" informazioni su ditte ed imprenditori (mentre altre volte, come nel caso delle registrazioni tramite la rete telefonica britannica – e con la collaborazione di tecnici inglesi! – bersaglio dello spionaggio era il mondo dei politici, a cominciare dai parlamentari europei.

Dopo le clamorose dimissioni del governo lussemburghese in luglio per il sospetto che qualche ministro fosse sui "libri-paga" della NSA, ecco esplodere analogo e ben più fondato "affare" in Francia. Gli USA e l'UE hanno, tempo fa, stipulato un accordo (mai definitivamente concluso ma ancora in fase di perfezionamento) col quale, allo scopo di collaborare nella lotta contro il terrorismo, USA e UE si sarebbero scambiate informazioni a riguardo. L'accordo non è mai stato concluso definitivamente perché gli USA pretendono informazioni che in UE le norme che riguardano la protezione della privacy vietato di fornire.
Fino ad ora ... sono stati in vantaggio gli USA. Per esempio, un cittadino dell'UE che si imbarca per gli USA deve compilare una scheda che fornisce molti dati personali tra i quali alcuni non sono, invece, richiesti ai cittadini USA che si imbarcano per un paese dell'UE.
Arriva ora una notizia ... calda calda; riguarda la seduta plenaria del PE di oggi pomeriggio.
In risposta al conclamato spionaggio USA (tramite l'agenzia investigativa NSA), il Parlamento Europeo propone di sospendere gli accordi di scambio di informazioni tra USA e UE.

The EU should suspend its Terrorist Finance Tracking Program (TFTP) agreement
with the US in response to the US National Security Agency's alleged tapping of EU
citizens' bank data held by the Belgian company SWIFT, says a non-binding
resolution voted by Parliament on Wednesday.
The resolution, tabled by the S&D, ALDE and Greens/EFA groups, was passed by 280
votes to 254, with 30 abstentions.
Although Parliament has no formal powers to initiate the suspension or termination of an
international deal, "the Commission will have to act if Parliament withdraws its support for
a particular agreement", says the approved text. It adds that Parliament will take account
of the Commission's response to this demand when considering whether to give its
consent to future international agreements.
Europol's investigation
MEPs deplore the fact that no EU member state has investigated these allegations. and
urge EU countries to authorise an inquiry by Europol's Cybercrime Centre. The resolution
also calls for a "full on-site technical investigation" of allegations of the US authorities
having had unauthorised access to, or having created possible "back doors" into, the
SWIFT servers.
The Civil Liberties Committee special inquiry into the mass surveillance of EU citizens
should also continue to look into the allegations, adds the text.
High data protection standards needed
Parliament stresses that any data-sharing agreement with the US must be based on a
consistent legal data protection framework, offering legally-binding standards on purpose
limitation, data minimisation, information, access, correction, erasure and redress
Background
The EU-US TFTP agreement on the processing and transfer of bank messaging data to
track terrorists' financial flows entered into force in August 2010. Press reports allege that
the US National Security Agency (NSA) has been tapping into EU citizens' personal
financial data handled by the Belgian company SWIFT. The US authorities' access to
these financial data is strictly limited by the TFTP deal. If proven, such activities would
constitute a clear breach of the EU-US agreement.
